Section 1 — About This Notice
Luma Field Inc (the "Company," "we," "our," or "us") operates a digital entertainment platform that provides promotional gameplay experiences to qualified participants. This Platform Participation & Availability Notice (the "Notice") has been prepared to inform you about who may use our platform, where our platform may be accessed, and what conditions apply to such access. Throughout this Notice, the entertainment experiences we provide are collectively referred to as the "Platform Services."
Section 2 — Governing Documents & Your Agreement
This Notice does not stand alone. It forms part of a broader framework of policies and agreements that together govern your relationship with the Company. By accessing or engaging with the Platform Services in any manner, you expressly acknowledge that you have reviewed, understood, and agreed to comply with all of the following documents, which are incorporated by reference into this Notice:
• The Game Statement, which defines the Platform Services and sets forth the general terms applicable to all participants;
• The Official Promotional Play Rules, which describe the mechanics, rules, and award structures of promotional activities;
• The Privacy Policy, which explains how your personal information is collected, processed, stored, and shared; and
• The Responsible Gaming Policy, which outline our commitment to responsible and ethical gameplay practices.
These documents (collectively, the "Governing Framework") are binding upon you from the moment you first interact with the Platform Services. If any conflict exists between this Notice and another document within the Governing Framework, the more specific provision shall control with respect to the subject matter it addresses.
Section 3 — Eligibility Requirements
Not every individual is eligible to create an account or participate in the Platform Services. The Company has established the following baseline qualification criteria, each of which must be satisfied concurrently:
Age Requirement. You must be at least twenty-one (21) years old at the time you register for or access the Platform Services. The Company reserves the right to request documentation verifying your date of birth at any point during your participation. Persons under the age of twenty-one are strictly prohibited from using the Platform Services under any circumstances.
Residency Requirement. You must be a lawful resident of one of the geographic areas designated as Qualifying Territories. The specific list of Qualifying Territories is maintained within and governed by our Promotional Sweepstakes Guidelines, which may be updated from time to time as regulatory conditions change.
Physical Presence Requirement. Beyond residency, you must also be physically situated within the borders of a Qualifying Territory each time you access or interact with the Platform Services. Traveling outside of a Qualifying Territory while maintaining an active session may result in service interruption or account restriction.
Section 4 — Geographic Restrictions & Excluded Jurisdictions
Due to variations in state and local regulatory frameworks, the Platform Services are not available in all parts of the United States. The following jurisdictions have been designated as Excluded Jurisdictions, meaning that individuals physically located within these areas are not permitted to access, register for, or otherwise engage with the Platform Services:
Alabama, California, Connecticut, the District of Columbia, Idaho, Louisiana, Michigan, Montana, Nevada, New Jersey, New York, and the State of Washington.
The Company monitors regulatory developments across all U.S. jurisdictions on an ongoing basis. The list of Excluded Jurisdictions is subject to modification at the Company's discretion as legal landscapes evolve. Any changes to this list will be reflected in an updated version of this Notice.
Section 5 — Location Verification Technology
To ensure compliance with the geographic restrictions described above, the Company employs location verification measures as part of its access protocols. When you use the Platform Services through a mobile device, we may activate and rely upon the geolocation features native to your device hardware, including but not limited to the Global Positioning System (GPS) receiver embedded in your device, to determine your approximate physical position.
This verification process is designed to confirm that you are within a Qualifying Territory before granting or maintaining access to the Platform Services. You may be prompted to enable location services upon launching the application, and disabling such services may prevent you from accessing certain features or the Platform Services entirely.
Accuracy Limitations. While geolocation technology generally provides reliable positioning data, the Company does not guarantee the absolute precision of any location determination. Factors including but not limited to atmospheric interference, proximity to tall structures, indoor usage, device hardware variations, and software configuration may cause deviation between your reported position and your actual physical coordinates. The Company shall not be held liable for any access denial or grant that results from inaccuracies in geolocation data.
Section 6 — User Compliance Obligations
Participation in the Platform Services is conditioned upon your ongoing adherence to applicable law. You bear exclusive and complete responsibility for independently verifying that your access to and engagement with the Platform Services does not violate any statute, regulation, ordinance, or other legal requirement in effect within your state, province, county, municipality, or other local governmental subdivision. The Company does not provide legal advice regarding the permissibility of participation in your specific locality, and nothing in this Notice or the Governing Framework shall be construed as a representation that participation is lawful in any particular jurisdiction.
Section 7 — Acknowledgment & Careful Review
By proceeding to use the Platform Services, you represent and warrant that you have carefully read each section of this Notice and that you fully understand the obligations, restrictions, and conditions described herein. If at any time you determine that you are unable or unwilling to comply with any provision of this Notice or the Governing Framework, you must discontinue all use of the Platform Services immediately and contact us to deactivate your account if applicable.
